Frequently Asked Questions

What are the course requirements for licensing?

After January 2006, Applicants for licensure will need a total of 210 classroom hours in “core” real estate study.  Each of our courses is 30 classroom “core” hours.  The courses required for a license are:

Principles I, 0111; Principles II, 0112; Law of Contracts 1200; Law of Agency 1111; and one "elective" core course.  The other 2 course requirements may be satisfied by any other “core” courses or by previous college work, if applicable.

Do I need a Real Estate Salesperson License?

Depending on what you seek to do, you may or may not need a license.  Please refer to the following TREC Enforcement Division questions:

Q. When does a person need a real estate license?

A. A person needs a real estate license when he/she is assisting another person in selling, renting, leasing or buying property and is getting paid for that service.

Q. I do not have a real estate license. Can I charge a locating fee to property owners for locating a person to rent their property?

A. No, you must have a real estate license to assist another person when renting or leasing out their property. However, the law allows an owner's employees to assist in the renting or leasing of the owner's own property. Otherwise, you must first obtain a license and be sponsored by, and working under, a real estate broker. All fees for real estate services must go through your sponsoring broker.

Section 3 of The Real Estate Licensing Act provides the following exceptions to the license requirement:

Sec. 3. The provisions of this Act shall not apply to any of the following persons and transactions, and each and all of the following persons and transactions are hereby exempted from the provisions of this Act:

(1) an attorney at law licensed in this state or in any other state;

(2) an attorney in fact under a duly executed power of attorney authorizing the consummation of a real estate transaction;

(3) a public official in the conduct of that person's official duties;

(4) a person calling the sale of real estate by auction under the authority of a license issued by this state provided the person does not perform any other act of a real estate broker or salesperson as defined by this Act;

(5) a person acting under a court order or under the authority of a will or a written trust instrument;

(6) a salesperson employed by an owner in the sale of structures and land on which said structures are situated, provided such structures are erected by the owner in the due course of the owner's business;

(7) an on-site manager of an apartment complex;

(8) transactions involving the sale, lease, or transfer of any mineral or mining interest in real property;

(9) an owner or the owner's employees in renting or leasing the owner's own real estate whether improved or unimproved;

(10) transactions involving the sale, lease, or transfer of cemetery lots;

(11) transactions involving the renting, leasing, or management of hotels or motels; or

(12) a partnership or limited liability partnership performing an act constituting an act of a broker or salesman, as defined by this Act, through a partner who is duly licensed as a real estate broker; or

(13) a person registered under Section 9A of this Act who sells, buys, leases, or transfers an easement or right-of-way for use in connection with telecommunication, utility, railroad, or pipeline service.

I have  a college degree (or some college work).  Will my college courses count toward a license?

More information about what courses will count toward your license is found on our Real Estate-Related Courses page.  You will need to send your college transcripts, if applicable, to the Texas Real Estate Commission using the Evaluation of Education Documents form, which is obtained from TREC website: www.trec.state.tx.us.  After review of your transcripts, TREC may grant you up to 60 classroom hours credit.  You will still need to take the 4 required courses and a core elective.

May I start classes if I haven’t had my college work evaluated?

It would be best that you enroll in one of the four required classes if you are waiting to see if you’ll receive credit for "related" work.  You can, of course, take more than the required number of courses and use them for annual renewals (SAE).

How long does TREC take to evaluate transcripts and completion certificates?

Processing of education documents takes approximately 10 to 14 business days once received by TREC, depending on work volume.  You will receive a letter by mail, stating what requirements you have met or still lack.  Applicants should not call TREC for inquiry unless they have reason to believe that TREC did not receive the mailed certificates.

I have a Real Estate Salesperson/Broker license in another state.  How can I get my license in Texas?

Texas has no license reciprocity agreements with other states.  Each case is evaluated separately regarding education requirements.  You will need to contact the Texas Real Estate Commission at 1-800-250-TREC.  They will need verification of what education you completed to receive your license and will inform you of what more you will need.  In almost all cases, you will need to take at least Law of Agency 1111 and Law of Contracts 1200.

How do I register for classes?

Click on "REGISTRATION" and follow the steps there.

Please be advised that classes fill quickly, so registration should be done as soon as possible, at least a full week before the class is scheduled to begin.  Registration is accepted in the order in which payment is received.

Where do I get my textbook for the class?

Included in tuition, Real Estate Education provides textbooks for each class, which are the students’ to keep.  The Principles I and Principles II classes both use the same text, the current edition Texas Real Estate Principles I & II  from Educational Textbook Company.

Do you offer correspondence courses?

We no longer offer distance learning courses.  Contact the Texas Real Estate Commission at www.trec.state.tx.us for a list of approved distance education providers.

If I have to miss a class session, is make-up work possible?

TREC Rules allow a student to miss up to 10 of the 30 classroom hours in a course and complete make up work to receive course credit.  You will need to contact Mr. Eddie Stockton who sets make-up work guidelines on a case-by-case basis.  Please be aware that in order to receive credit for the course, excellent attendance is mandatory.

What are SAE and MCE?

A Salesperson is required to complete 60 additional classroom hours during their first year of licensure.  This education is referred to as Salesperson Annual Education (SAE).  Note that the hours for SAE may be completed at any time; Some students prefer to take these extra courses immediately following their required hours. 

After fulfilling SAE requirements, a licensee will need a 15-hour MCE (Mandatory Continuing Education) class to renew their license.  Eddie Stockton teaches MCE courses periodically through Lamar State College- Orange (Provider #0496).

Do you offer courses in the daytime?

Real Estate Education, Inc. only offers courses as scheduled- on evenings and weekends.  Currently, all courses are scheduled for Tues, Wed, Thurs nights and Saturday-Sunday.  Course times for evening sessions (T-W-Th) are 5:30pm to 9:30pm.  Day sessions (Sat-Sun) are 8:00am-6:00pm, with an hour break for lunch.  Attendance for all 5 days is mandatory.

Do courses expire?

No, courses do not expire, as long as you keep your certificates.  If it has been an exceedingly long time since you took the courses, you may want to check to be sure that you are in compliance with the current state requirements.

What can I do if I’ve lost my certificate of completion?

We will need your name (at time of registration), the name of the course, and the approximate date of completion.  We are only required to keep records for five years.  If it is beyond five years, we can check our records, however, there will be additional charges to look up these records in the archives.  A Letter of Certification will be issued, listing all of the education you have completed with us; this is then sent to TREC for evaluation.
